Privacy Policy

This privacy policy (the “Policy”) explains how and for what purposes KIDS.RADIO INC, a California corporation, d/b/a “Kids.Radio”, and its related companies (collectively, “Kids.Radio”, “we”, “us”, or “our”) collects, uses, and shares information of users (“you” or “your”) of the website “www.kids.radio”, and on any other websites or apps that we own where this Policy is posted (individually, and collectively, the “Site”).

  1. Kids.Radio values the privacy of our users and takes the privacy of your information very seriously. We want to earn your trust by being transparent about how the Site works. Please read this Policy carefully. By using the Site in any way, you (a) represent that you have read and understand this Policy, and (b) agree to be bound by this Policy.
  2. CHILDREN’S ONLINE PRIVACY PROTECTION ACT.

    This Policy explains our information collection, disclosure, and parental consent practices with respect to information provided by children under the age of thirteen (13). This policy is in accordance with the U.S. Children’s Online Privacy Protection Act (“COPPA”), and outlines our practices in the United States regarding children’s personal information.   3. If you need help understanding this document, you should ask a parent or guardian to read it and talk with you about it. This document covers services aimed at children, however, if you are an adult using these services, this Policy also covers data collected about you. If you are a parent or guardian who is using the Site, this Policy explains how we process information we collect in relation to your child.

  1. INFORMATION THAT YOU PROVIDE US.

    Kids.Radio offers a variety of activities for users of all ages and their families. Some of these activities will ask for information from you so you can use the Site. We might need to ask permission from your parent or guardian before you can give us this information. This information can include, but is not limited to, the following:
    • (a) CONTACT AND ACCOUNT DETAILS. When you register for the Site, we may collect the following information: (i) Your first and last name; (ii) Your email; (iii) The email of your parent and/or guardian; (iv) Your username and password; (v) Your gender; (vi) Your date of birth; and (vii) Your rough geographic location (city and state and/or zip code).
    • (b) PAYMENT INFORMATION. Some of our services allow you to become a paid subscriber for access to premium services or buy things on the Site. Before paying for any services offered on the Site, you should get permission from your parent or guardian.
    • (c) CONVERSATIONS WITH FRIENDS. Certain activities on the Site may allow you to communicate with other users by means of a chat system. We will make best efforts to employ filters or have moderators to take steps to stop people from using bad words, sharing personal information, or engaging in other illegal or inappropriate activity. We will not use the information gathered from your conversations for any purpose other than to provide the services on the Site. We strongly encourage you to never provide personal information about yourself to a third party. We also recommend that parents and guardians carefully supervise their children when they participate in online activities.
    • (d) SOCIAL MEDIA. If you interact with our social media pages, we may collect information when you participate in activities such as commenting, sharing, or “liking” a post or video. We may also receive information that you share on your social media page or channel, such as your profile picture, your birthday, your list of friends, and your likes and follows. We may need to ask permission from your parent or guardian before we can collect this information through social media.
    • (e) CONTESTS AND SWEEPSTAKES. For contests and sweepstakes, we typically require only the information necessary for you to participate, such as legal name and email address, or the email address of your parent or guardian to notify your parent or guardian where required by law. We will contact your parent or guardian for more personalized information for prize-fulfillment purposes if you win the contest or sweepstake.
    • (f) PUSH NOTIFICATIONS. Push notifications are alerts on mobile and other devices that are typically associated with downloaded applications, and which can communicate with you even when the application is not in use. We may need to ask permission from your parent or guardian to send you these push notifications. You can always turn push notifications off in the settings of your device. If you need help with the push notifications, make sure to ask your parent or guardian for help.
    • (g) WHEN YOU CONTACT US. We may ask for your contact information if you contact us by email or using an online form for help. For example, this may include your first name and email address. We will also ask you to tell us why you are contacting us. Once we have helped you, we will delete your personal information relating to this contact.
  2. PASSIVE INFORMATION.

    When you use the Site, certain information may be automatically collected as well. Other information we may collect regarding your usage of the Site includes:
    • (a) SITE ACTIVITY INFORMATION. We may keep track of the actions you take on the Site, such as details of your visits to the Site, the resources you access, any data viewed, uploaded or downloaded, the number of times you view a particular section of the Site, and/or any comments you provide as a customer or user of the Site.
    • (b) ACCESS DEVICE AND BROWSER INFORMATION. When visiting the Site, we may log your computer operating system type, browser type, browser language, the website you visited before browsing to the Site, pages you viewed, how long you spent on a page, access times, Internet protocol (IP) address, information about your use of and actions on the Site, and geolocation data. We will ask for consent from your parent or guardian before we collect geolocation information that is specific enough to equate to the collection of a street address.
    • (c) COOKIE INFORMATION. We may log information using “cookies.” Cookies are small data files stored on your hard drive by a website. We may use cookies to help us make our Site and your visit better. We do not use behavioral advertising cookies or conduct targeted advertising on any areas of the Site used by minors.
    • (d) WEB BEACONS. We may log information using digital images called “web beacons” on the Site or in our emails. We may use web beacons to manage cookies, count visits, and/or to learn which content is being accessed. We may also use web beacons to tell if you open or act on our emails.
    • (e) THIRD-PARTY ANALYTICS . We may use automated devices and applications, such as Google Analytics to collect the above information to assist in the evaluation of the use of our services. We may use these tools to gather non-personal data about users to help us improve the Site, our services, and user experiences. These third-party analytics providers may use cookies and other technologies to perform their services, and may combine the information they collect about you on our Sites with other information they have collected for their own purposes. Such third-party analytics providers may have their own privacy policies and we do not accept any responsibility or liability for the protection of any data supplied to other sites. To opt-out of the use of certain information collected by Google Analytics, you may visit: https://tools.google.com/dlpage/gaoptout. Please note that if you opt out using this method, the opt out will only apply to the specific browser or device from which you opt out. We are not responsible for the effectiveness of, or compliance with, any opt out options or programs, or the accuracy of any other entities’ statements regarding their opt out options or programs.
  3. In the event that we collect (or allow others to collect) information about you for other purposes not listed in this Policy, we will notify your parent or guardian as described below in section 6.

  5. If you do not provide information which we reasonably request, then you may not be able to access the full range of features on the Site and/or our products and services.

We take steps to ensure that others use information that you share on the Site in a manner consistent with this Policy and our Terms of Use , but we cannot guarantee that they will follow our rules. Please review this section to learn more about how you can protect yourself when you share information with third parties.
  2. SHARING INFORMATION ON THE SITE.

    We designed the Site to enable you to review and edit your information in the applicable section of the Site. Parents or guardians are required to consent before any collection, use, or disclosure of your personal information, and may review or delete your personal information at any time. Such consent and steps to change your information are described below in sections 6 and 7.
  3. If you use an external source to publish information to the Site, you should check the privacy setting for that external source.
  4. We can, and you hereby authorize us to, disclose any information to law enforcement or other government officials that we, in our sole discretion, believe necessary or appropriate in compliance with the law and/or government requests.

    • (a) Administer your accounts with us;
    • (b) Process materials submitted by you;
    • (c) Contact you with information about goods and services, including enhancements and upgrade opportunities;
    • (d) Provide you with information, products, or services that you request from us;
    • (e) Respond to support requests;
    • (f) Verify your identity;
    • (g) Carry out marketing analysis and make general improvements to the Site;
    • (h) Obtain your views or comments on the services we provide or to ask you to participate in surveys;
    • (i) Contact the winners of any competitions and help us plan other promotional activities;
    • (k) Ensure that content from the Site is presented in the most effective manner for you and for your computer;
    • (l) Carry out our obligations arising from any contracts or agreements entered into between you and us; and/or
    • (l) Protect, investigate, and deter against fraudulent, unauthorized, or illegal activity.
  2. We may also provide users, the public, and/or third parties (e.g., advertisers) with aggregate and/or anonymous information about our users. We may provide such aggregate and/or anonymous information to help users of the Site, to help the public, to help third parties reach the kind of audience they want to target, and/or to help market the Site.
  3. We may also display to visitors of the Site any or all of your information that is publicly available and/or any other information you elect to share. You can change your information, as described in section 7.

We share your information with third parties when we believe the sharing is permitted by you, reasonably necessary to offer our services, and/or when we are legally required to do so. Specifically, we may share your information as follows:
  • (a) With your consent;
  • (b) When we do a business deal, or negotiate a business deal, involving the sale or transfer of all or a part of our business or assets;
  • (c) For legal, protection, and safety purposes. For example, to comply with laws or to respond to lawful requests and legal processes;
  • (d) To protect our rights and property, and the rights and property of our agents, customers, and others. This includes enforcing our agreements, policies, and Terms of Use ;
  • (e) In an emergency. This includes protecting the safety of our employees and agents, our customers, or any person;
  • (f) With those who need it to do work for us, including, but not limited to, the credit card processor, which may retain information for processing additional transactions, refunds, and/or chargebacks; and/or
  • (g) We may also share aggregated and/or anonymized data with others for their own uses.

  1. EMAIL CONSENT.

    In the event that Kids.Radio wishes to collect personal information from you, COPPA requires that we first seek consent from your parent or guardian via email. In the email, we will explain what information we are collecting, how we plan to use it, how the parent or guardian can provide consent, and how the parent can revoke consent. If we do not receive parental consent within a reasonable time, we will delete the parent contact information and any other information collected from the child in connection with that activity.
  2. HIGH-LEVEL CONSENT.

    In the event that Kids.Radio collects personal information from you that will be posted publicly, we will seek a higher level of consent than email. Such “high-level” methods of consent could include, but are not limited to, asking for a credit card or other payment method for verification (with either a nominal charge or zero dollar verification involved), speaking to a trained customer service representative by telephone or video chat, or requiring a signed consent form by mail, email attachment, or fax. After providing high-level consent, a parent or guardian may have the opportunity to use a pin or password in future communications as a way to confirm the parent or guardian’s identity.

  1. At any time, parents can refuse to permit us to collect further personal information from their children in association with a particular account, and can request that we delete from our records the personal information we have collected in connection with that account. Please keep in mind that a request to delete records may lead to a termination of an account, membership, or other service.
  2. VIEWING AND EDITING YOUR INFORMATION.

    You and/or your parent or guardian may change or delete your profile information at any time by going to your account page and clicking the appropriate link. You may need to supply certain information so that we can attempt to verify that you have the authority to modify this information, which will subsequently be updated immediately.
  3. DELETING YOUR ACCOUNT.

    If you and/or your parent or guardian want to stop using your account, you may delete it. When you delete an account, it is permanently deleted. You should only delete your account if you are certain you never want to use it again. To delete your account, email info@kids.radio with the subject: “Please delete my account”. You may need to supply certain information so that we can attempt to verify that you have the authority to delete the account, which will subsequently be deleted immediately.
  4. LIMITATIONS ON REMOVAL.

    Even after you remove information from your profile or delete your account, copies of that information may remain viewable elsewhere to the extent it has been shared with others or it was copied or stored by other users. Additionally, we may retain certain information to prevent identity theft and other misconduct even if deletion has been requested.
  5. OPT OUT.

    If you and/or your parent or guardian do not want us to contact you in respect of goods or services, you may opt out at any time. You can exercise this right at any time by either unsubscribing via the link on the Site or by emailing: info@kids.radio. If you opt out, we may still send you non-marketing emails. Non-marketing emails include emails about your account and our business dealings with you.
  6. REQUESTS ABOUT YOUR PERSONAL INFORMATION.

    You and/or your parent or guardian may send requests about personal information to: info@kids.radio.
  7. COOKIES.

    You and/or your parent or guardian can typically remove and reject cookies from the Site with your browser settings. Many browsers are set to accept cookies until you change your settings. If you remove or reject our cookies, it could affect how our Site works for you.
  8. DO NOT TRACK.

    We do not currently respond to “Do Not Track” signals.

  1. We do our best to keep your information secure. However, no company can fully prevent security risks, mistakes may happen, and bad actors may defeat even the best safeguards.
  2. STEPS WE TAKE TO KEEP YOUR INFORMATION SECURE.

    The Site uses a security system that protects any personal information that is stored on our servers from unauthorized use. However, as no data transmissions over the Internet can be guaranteed to be 100% secure, we cannot take responsibility for any unauthorized access or loss of your information that is beyond our reasonable control.
  3. RISKS INHERENT IN SHARING INFORMATION.

    We cannot control the actions of other users with whom you share your information. We cannot guarantee that only authorized persons will view your information. We cannot ensure that information you share on the Site will not become publicly available. We are not responsible for third party circumvention of any security measures on the Site. You can reduce these risks by not publicly sharing personal information, and using common sense security practices such as choosing a strong password, using different passwords for different services, as well as using up-to-date antivirus software.
  4. REPORT VIOLATIONS.

    You should report any security violations to us by emailing: info@kids.radio.
  5. ENFORCEMENT.

    We regularly review our compliance with the Policy. If we receive a formal written complaint, we will contact the person who made the complaint to follow up. We work with the appropriate regulatory authorities to resolve any complaints regarding the transfer of personal data that we cannot resolve with our users directly.

  1. We may change this Policy at any time. If we make any changes, we will change the Effective Date below, and where appropriate, may notify you and/or your parent or guardian via e-mail or announcement on the Site.
  2. By using the Site, you signify your acceptance of the revised privacy policy.

Any dispute or claim arising out of or in connection with this Policy or its subject matter that involve state law shall be governed by and construed according to the laws of the state of California, without giving effect to any conflict of laws provisions.

If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for the protection of any data supplied to other sites. Additionally, the fact that we may link to a website is not an endorsement, authorization, or representation of an affiliation with that third party, nor is it an endorsement of their privacy or information security practices or policies. We encourage you to read the privacy policies and statements of the other websites that you visit and services that you use.
